Terms of Service

The terms that apply when you use our website, purchase a CF7 Toolbox product, or access our related services.

Last updated:

1. Agreement and scope

These Terms of Service govern your use of cf7toolbox.com and the products and related services provided under the CF7 Toolbox name. In these terms, "we", "us" and "our" mean CF7 Toolbox. "You" means the person or organization using or purchasing them.

By accepting these terms at checkout or through another acceptance process, you agree to them. Your use of the website is subject to these terms to the extent permitted by applicable law. You must have legal capacity to enter into the agreement and authority to act for any organization you represent.

Your order includes the product description, selected plan and specific conditions disclosed before purchase. Those conditions govern their specific subject matter if they differ from these general terms. Separate software licenses and checkout provider terms apply as described below.

2. Orders, payments and delivery

Review the product, site allowance, billing period, currency, taxes and total price before submitting an order. Provide accurate billing information and use a payment method you are authorized to use. A purchase covers only the items and services identified in the accepted order.

We use Freemius for checkout and related commerce services. Where Freemius is identified as the merchant of record, its terms of sale govern the transaction and its responsibilities as the seller of record. Our responsibilities for our products and services remain governed by the applicable product agreement.

Digital delivery follows successful payment and any necessary verification, using the access instructions supplied with the order. Orders may be declined or delayed for payment failure, suspected fraud or legal restrictions. If a paid order cannot be fulfilled, the payment for the unfulfilled item will be returned through the applicable checkout process.

We may change prices and offers for future purchases. A pricing error does not authorize an additional charge without your agreement.

3. Software licenses and service access

The license supplied with each software package governs your rights to use, copy, modify and distribute that software. Where an open-source license applies, including the GNU General Public License, these terms do not restrict the rights it grants.

Paid entitlements, such as official updates, support, downloads and connected services, are separate from the underlying software license. Their duration, site allowance and scope are those stated in your plan. A purchase does not include future products or services unless the offer expressly includes them.

Keep account credentials and license keys confidential. Do not resell, publish or share access to paid services beyond your plan, unless we authorize it. You may manage client websites where your plan permits it and you have the client's authority. Software redistribution rights do not automatically transfer your paid service entitlements to another person.

4. Subscriptions, cancellation and refunds

Recurring purchases

Only purchases expressly identified as recurring are subject to automatic renewal. The billing frequency and renewal terms are those disclosed at checkout. Any renewal price change will be communicated in advance as required, with an opportunity to cancel before it applies.

Stopping future renewals

Cancel using the subscription management method provided with your order before the next renewal is processed. Contact us if you need assistance. Cancellation normally stops future renewals and leaves the current paid service period in place. It does not by itself refund an existing payment or create a right to a prorated refund.

Refund requests

Refund eligibility follows any refund policy expressly presented with your purchase, the applicable checkout terms and mandatory law. Send your order reference and the reason for your request so it can be reviewed. Outside those entitlements, any additional refund is discretionary. These terms do not remove a statutory cancellation right or a remedy for a product that fails to meet applicable legal requirements.

When a service period ends, associated updates, support and other paid services may end as stated in the plan. Any continuing software use remains subject to its applicable license.

5. Updates, compatibility and support

Updates and support are provided within the scope and period included in your purchase. Support concerns our products used within their documented requirements. Unless separately agreed, it does not include custom development, website administration, data recovery or work on unrelated third-party software.

To investigate an issue, we may request relevant version information, reproduction steps and a safe test environment. Support does not include a guaranteed response or resolution time unless expressly stated in your plan or a separate written agreement.

We may release fixes, revise features and update supported requirements as the software evolves. Future features and release dates are not purchase commitments unless expressly included in your order. Changes remain subject to the commitments made for your paid service period and any legally required updates or remedies.

6. Your website, account and data

You are responsible for choosing a suitable product, checking documented requirements, maintaining your hosting and website, and protecting access credentials. Keep restorable backups and test installations, updates and important workflows before relying on them in production.

You control the forms and records on websites you operate. You are responsible for lawful collection and use, appropriate notices and permissions, access controls, retention and exports. An addon does not replace your own operational checks, backup arrangements or legal obligations.

Only provide support materials you are entitled to share. Remove unnecessary personal information and agree any website access arrangements with us first. Our handling of information is explained in our Privacy Policy.

7. Acceptable use

You must not use our website or services to:

  • Commit fraud, distribute malware, conduct phishing or violate another person's rights.
  • Access accounts, systems or non-public information without authorization.
  • Disrupt service availability, overload our systems or circumvent controls protecting paid service access.
  • Misrepresent your identity, payment authority or eligibility for a plan, discount or refund.
  • Threaten or harass our team or other users.

These restrictions do not prohibit activities permitted by a software license or rights that applicable law does not allow us to restrict.

8. Intellectual property and third-party services

CF7 Toolbox branding, website materials and other protected content belong to us or their respective rights holders. Except as permitted by law, an applicable license or written permission, you may not reproduce them for commercial distribution or imply our endorsement of your business. Purchasing a product does not transfer ownership of our trademarks.

Third-party software and services remain subject to their own licenses and terms. Their providers control their operations and availability. References to WordPress, Contact Form 7 or other third-party names do not grant trademark rights or imply endorsement.

If you voluntarily provide suggestions, you allow us to use them to improve our products without a payment obligation. This does not grant us ownership of your website, customer records or confidential support materials.

9. Scope of warranties

Our product commitments are those expressly included in the applicable product description and agreement. Except for those commitments and warranties required by law, the website, software and services are provided "as is" and "as available" to the fullest extent permitted by law.

We do not provide additional warranties of uninterrupted operation, compatibility with every third-party environment or suitability for an undisclosed purpose. Examples and demonstrations are illustrative and do not promise a particular commercial outcome.

Nothing in these terms excludes a mandatory warranty or overrides a specific commitment included in your purchase.

10. Limitation of liability

To the fullest extent permitted by applicable law, we are not liable for indirect, incidental, special or consequential losses, including lost profits, revenue, business opportunities or goodwill, arising from the use of our products or services.

Subject to the exceptions below, our total aggregate liability for claims relating to an affected product or service is limited to the amount you paid for it during the 12 months before the event giving rise to the claim. For a one-time purchase, the limit is the purchase price paid for the affected product.

These exclusions and limits do not apply to fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded or limited. Mandatory consumer rights and remedies remain unaffected.

11. Third-party claims involving business users

If you act for business purposes, you agree, to the extent permitted by law, to indemnify us against third-party claims, damages and reasonable legal costs to the extent caused by your unlawful use of our services, infringement of another person's rights or material breach of these terms.

This obligation does not apply to the extent a claim results from our own breach, negligence or willful misconduct. We will give prompt notice of a relevant claim and reasonable cooperation. No settlement may impose an admission or non-monetary obligation on you without your consent, which must not be unreasonably withheld. This section does not apply to consumers acting outside their business or profession.

12. Suspension and termination

We may restrict or suspend account access or paid services where reasonably necessary to address non-payment, suspected fraud, a security threat, unlawful conduct or a material breach of these terms. We may terminate affected services for a serious or unremedied material breach.

Where practical and appropriate, we will explain the issue and allow a reasonable opportunity to resolve it. Immediate action may be necessary to protect systems or comply with law. Any review or remedy will take account of the circumstances and applicable legal rights.

Ending service access does not cancel amounts lawfully due or automatically terminate rights granted under a separate open-source license. Provisions that by their nature should continue, including intellectual property and applicable liability provisions, survive termination.

13. Changes, disputes and general terms

We may update these terms for changes in our services, legal requirements or operating arrangements. The revision date appears above. Revised terms apply to future purchases. Material changes affecting an ongoing service will be communicated in advance where required, with consent or other legally required options provided. Revisions do not retroactively remove rights attached to an accepted order.

If a concern arises, contact us with the relevant details so we can seek a practical resolution. This does not prevent either party from using a competent court, a statutory dispute process or an urgent legal remedy. Applicable law and jurisdiction are determined under the relevant legal rules; mandatory consumer protections remain available.

If a provision is unenforceable, the remainder continues to apply to the extent permitted by law. A delay in enforcing a provision is not a waiver. These terms and the applicable order documents form the agreement for their subject matter, without excluding rights or representations that cannot lawfully be excluded.
